What a notice should include

So that we can act on it, a notice under the US Digital Millennium Copyright Act needs:

  • your physical or electronic signature, as the copyright owner or a person authorised to act for them
  • the copyrighted work you say has been infringed
  • the material you say is infringing, and where it is: the app and the place in it, or the web address, in enough detail for us to find it
  • your name, postal address, phone number and email address
  • a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law
  • a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or are authorised to act for the owner

Under US law, a person who knowingly makes a false claim in a notice can be liable for damages.

Counter-notices

If an app lets you post material, and yours was removed after a notice, you can send a counter-notice to the same agent if you believe it was removed by mistake or misidentification. It needs your signature, the material that was removed and where it appeared, a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification, your name, address and phone number, and a statement that you consent to the jurisdiction of the US federal district court for the district where your address is or, if your address is outside the United States, for any district in which QOQ Design Ltd may be found, and that you will accept service of process from the person who sent the original notice or that person’s agent. The same liability for knowingly false claims applies to a counter-notice.
